CPUC INVESTIGATIONS RESULT IN ENFORCEMENT ACTIONS
AND FINES IMPOSED ON VARIOUS LIMOUSINES,
SHUTTLES, AND BUS COMPANIES

SAN FRANCISCO, October 27, 2008 - The California Public Utilities Commission (CPUC), in its ongoing commitment to consumer protection, has taken a number of actions in the third quarter of 2008 to protect consumers from illegally operating passenger carriers.

The CPUC's Consumer Protection and Safety Division (CPSD) took the following enforcement actions against limousine, bus, and shuttle companies for violations of the Public Utilities Code and CPUC rules and regulations, including General Order (G.O.) 157-D.

Administrative Citation

Nineteen companies were cited and fined (totaling $57,250) for violations ranging from:

1. Engaged employees without procuring evidence of workers' compensation insurance

2. Engaged unlicensed sub carriers in violation of G.O. 157-D

3. Failed to comply with G.O. 157 rules (equipment list, waybills, out of class drivers, vehicle not properly SPAB certified)

4. Failed to enroll drivers in a mandatory Drug and Alcohol program

5. Failed to enroll drivers in DMV Pull Notice program

6. Failed to pay PUCTRA fees or under-reported gross revenue

7. Failed to respond and provide business records upon request in a timely manner

8. Operated with no evidence of public liability insurance in effect and on file

9. Operated without a valid authority (suspension, revocation, expiration, outside of the scope of its authority, or unlicensed)

Joint sting operation with San Diego Police Department, Southern Division resulting in a filing by the San Diego City Attorney's office charging the defendant with one count of CPUC Code section 5371 - transporting passengers without a valid CPUC permit in force. Defendant pled out and paid a $450 fine.

Phone Disconnect

In its ongoing efforts to clamp down on unlicensed passenger carriers, the CPUC had telephone service shut off to the limousine company below for operating in California without a charter-party permit. This company continues to advertise and hold itself out to engage in the business of transporting passengers, notwithstanding CPUC staff directives to immediately stop unlawful acts and to obtain a charter-party permit. According to Section 5371.6 of the Public Utilities Code, any person aggrieved by this action may file a complaint with the CPUC and request a hearing.

1. City Lights Limousine LLC, Modesto (PSG 17701-Denied) Defendant operates and advertises its limousine business in various media such as the Red Bow Wedding Guide 2007, colored postcards, and on the Internet. Defendant was administratively fined in November 2005 for operating without a valid permit. Defendant paid the fine and applied for a permit but failed to follow through with the licensing requirements. Defendant continues to operate and advertise. On July 29, 2008, CPSD obtained an order "Finding of Probable Cause" signed by Stanislaus County Superior Court Judge Marie Sovey Silveira. The order finds that telephone service at three numbers was being used to violate criminal laws of the State of California. Defendant may file a complaint and request a hearing before the CPUCC.

Forty-two companies were issued Official Notice for one or more of these violations:

1. Advertised vehicles that were beyond the scope of operating authority

2. Engaged unlicensed sub-carriers

3. Engaged workers without evidence of workers' compensation insurance

4. Failed to complete alcoholic statements for minors

5. Failed to enroll drivers in Controlled Substance and Alcohol Testing Certification program

6. Failed to enroll drivers in the DMV Employee Pull Notice program

7. Failed to maintain records

8. Failed to notify CPUC on use of fictitious business name.

9. Failed to update equipment list and no Livery Plates

10. Operated and advertised without a valid permit (prior to issuance, expired, unlicensed)

11. Operated as a taxicab

12. TCP number not displayed on advertisements, vehicles and waybills

13. Transported passengers without a waybill

14. Under-reported gross revenue and underpaid PUCTRA fees
