SCOPING MEMO AND RULING OF ASSIGNED COMMISSIONER AND ADMINISTRATIVE LAW JUDGE ESTABLISHING CATEGORY, SETTING SCHEDULE, AND ASSIGNING PRINCIPAL HEARING OFFICER

Summary

Pursuant to Rules 6(a)(3) and 6.3 of the Commission's Rules of Practice and Procedure1, this ruling addresses the scope of the proceeding, sets forth a procedural schedule, and assigns the principal hearing officer following a prehearing conference (PHC) held on August 1, 2000. This ruling is appealable only as to the proceeding's categorization under the procedures set forth in Rule 6.4.

Background

In these applications, Southern California Edison Company (Edison), Pacific Gas and Electric Company (PG&E), San Diego Gas & Electric Company (SDG&E), and Southern California Gas Company (SoCalGas) (collectively, the utilities), seek to recover shareholder incentives for attainment of milestones for program year (PY) 1999 Energy Efficiency Programs (EEP), and for achieving savings for PY 1998 and 1999 Low-Income Energy Efficiency (LIEE) Programs and for Demand-Side Management (DSM) accomplishments related to pre-1998 program commitments. No protests or other responses were filed. By rulings dated June 26, 2000, and July 20, 2000, respectively, the utilities were ordered to serve on interested parties workpapers and data supporting the applications, and interested parties were ordered to file PHC Statements identifying issues and other matters to be included in the scoping memo. A PHC was held on August 2, 2000. The utilities, the Office of Ratepayer Advocates (ORA), The Utility Reform Network (TURN), the California Energy Commission, the Residential Energy Efficiency Clearing House, Inc. (REECH), the Natural Resources Defense Council (NRDC), the Residential Energy Service Companies' United Effort (RESCUE), and SESCO, Inc. appeared at the PHC and indicated an intent to participate in the proceeding. Others appeared and were granted information only status.
