ADMINISTRATIVE LAW JUDGE'S RULING SETTING HEARING
NOTICE IS HEREBY GIVEN that the Public Utilities Commission of the State of California has set a hearing in the appeal of Lia T. White, White Construction Company (White), of the denial of certification by the supplier clearinghouse, Asian Inc. (Asian), before Administrative Law Judge Hallie Yacknin, for December 16, 2008, at 9 a.m., in the Commission Courtroom, State Office Building, 505 Van Ness Avenue, San Francisco, California.
The record of this proceeding shall include the October 8, 2008, letter of formal appeal of Asian's denial of minority women-owned business certification, from White to Chief Administrative Law Judge Angela Minkin.
In addition, I direct Asian to provide me a copy of Asian's final decision resolving White's verification challenge (referenced in sections 7.2.3 and 7.3.1 of General Order 156) by no later that November 13, 2008, with concurrent service on White.
By no later than December 1, 2008, White and Asian shall serve on me and on each other (1) a copy of all documents that you wish to enter into the record at the hearing, and (2) a list of all persons who you intend to present as witnesses to testify at the hearing, along with a brief description of their respective roles and relevance to this matter.
While this appeal is pending, neither White nor Asian shall engage in ex parte communications with decisionmakers, including myself, except for scheduling or procedural purposes.
IT IS SO RULED.
