The draft decision of the ALJ in this matter was mailed to the parties in accordance with Pub. Util. Code § 311(g) and Rule 77.7 of the Rules of Practice and Procedure. Comments were filed on ____________________, and reply comments were filed on ________________.
1. Pacific currently operates a shuttle service between and among the points set forth in its application.
2. Granting the application would merely change the existing service from one which is operated under charter arrangements into one that is operated by collecting individual fares, without affecting the public need for the service.
3. Pacific is operationally fit to operate the proposed service.
4. Pacific is financially fit to operate the proposed service.
5. Pacific is already operating in the same vicinity under PSC-1411.
1. Pacific's application to operate its existing shuttle service on an individual fare basis should be granted.
2. The filing fee provided in Pub. Util. Code §1904(a) is applicable to this application in lieu of that under § 1036(a).
3. Pacific should, therefore, be required to pay a filing fee of $75.
IT IS ORDERED that:
1. The certificate of public convenience and necessity (CPCN) granted to applicant, authorizing it to operate as a passenger stage corporation, as defined in Pub. Util. Code § 226, to transport persons and their baggage, between the points and over the routes set forth in Appendix PSC-1411 of Decision 92-08-062, as amended, is further amended by replacing Fourth Revised Page 3 and Original Page 7, with Fifth Revised Page 3 and First Revised Page 7, granting the extension requested in the application, subject to the conditions contained in the following paragraphs.
2. Applicant shall:
a. File a written acceptance of this certificate within 30 days after this order is effective.
b. Establish the authorized service and file tariffs and timetables within 120 days after this order is effective.
c. State in its tariffs and timetables when service will start; allow at least 10 days' notice to the Commission; and make timetables and tariffs effective 10 or more days after this order is effective.
d. Comply with General Orders Series 101, 104, and 158, and the California Highway Patrol (CHP) safety rules.
e. Comply with the controlled substance and alcohol testing certification program pursuant to Pub. Util. Code § 1032.1 and General Order Series 158.
f. Maintain accounting records in conformity with the Uniform System of Accounts.
g. Remit to the Commission the Transportation Reimbursement Fee required by Pub. Util. Code § 403 when notified by mail to do so.
h. Comply with Pub. Util. Code §§ 460.7 and 1043, relating to the Workers' Compensation laws of this state.
i. Enroll all drivers in the pull notice system as required by Section 1808.1 of the Vehicle Code.
3. Applicant is authorized to begin operations on the date that the Rail Safety and Carriers Division mails a notice to applicant that its evidence of insurance and other documents required by Ordering Paragraph 2 have been filed with the Commission and that the CHP has approved the use of applicant's vehicles for service.
4. Before beginning service to any airport, applicant shall notify the airport's governing body. Applicant shall not operate into or on airport property unless such operations are authorized by the airport's governing body.
5. The extension of the CPCN to operate its passenger stage corporation (PSC-1411) granted herein, expires, unless exercised within 120 days after the effective date of this order.
6. Applicant shall pay a filing fee of $75 under Pub. Util. Code § 1904(a).
7. A.99-08-037 is closed.
This order is effective today.

SECTION II. SERVICE AREA.
A. Disneyland Service Area (Anaheim City) (Route A)
That portion of the City of Anaheim, which is bounded by; Vermont Ave on the north, State College Blvd on east, Anaheim city limit on the south, and Walnut St on the west.
B. Anaheim Service Territory (Route B)
All of the hotels and motels which are bounded by; Lincoln Ave on the north, State College Blvd on the east, Chapman Ave on the south and Euclid Ave on the west.
C. Five City Origin Territory (Route D)
Within the incorporated city limits of Anaheim, Buena Park, Fullerton, Garden Grove, and Orange, located within the County of Orange.
D. Airport Service
Between points in Orange County, on the one hand, and Los Angeles International and John Wayne Airports, on the other hand. This service may also be operated on an on-call basis.
*E. Disneyland Shuttle Service Territory (Route G)
Between points within two air miles from the perimeter of Disneyland that encompasses a portion of the cities of Anaheim, Garden Grove and Orange. This service will be provided on a scheduled basis.
