Enclosed is Agenda ID #1279 Alternate Draft Decision of Commissioner Wood to the Draft Decision of Administrative Law Judge (ALJ) Walker. A courtesy copy of ALJ Walker's draft decision is also enclosed. This item, originally scheduled for the October 3, 2002 Commission meeting, is on the Commission's agenda for November 7, 2002.

When the Commission acts on this agenda item, it may adopt all or part of it as written, amend or modify it, or set aside and prepare its own decision. Only when the Commission acts does the decision become binding on the parties.

As set forth in Rule 77.6, parties to the proceeding may file comments on the enclosed alternate at least seven days before the Commission meeting or no later than October 31, 2002. Reply comments should be served by November 5, 2002. An original and four copies of the comments and reply comments with a certificate of service shall be filed with the Commission's Docket Office and copies shall be served on all parties on the same day of filing. The Commissioners shall be served separately by overnight service.

OPINION

1. Summary

Wickland Pipelines LLC (applicant, or Wickland) seeks Commission approval of an environmental review, a new corporate membership structure, additional membership capital contributions, issuance of promissory notes, and authorization of market-based rates in connection with its operation of a jet fuel pipeline and tank farm project at Sacramento International Airport. The application is unopposed. The application is granted to the extent set forth below. Wickland's request for authorization for market-based rates is denied without prejudice.
