4. Comments on Draft Decision

The draft decision of the ALJ in this matter was mailed to the parties in accordance with Pub. Util. Code § 311(g)(1) and Rule 77.7 of the Rules of Practice and Procedure. Comments, if any, are to be filed within 20 days of the date of mailing.

Findings of Fact

1. The relief requested by complainants has been granted by the Commission in D.01-02-018.

2. Because the relief requested has been granted, the complaint in C.00-10-010 is moot.

Conclusion of Law

This case should be dismissed without prejudice, effective immediately.

IT IS ORDERED that Case 00-10-010 is dismissed without prejudice to refiling should Foresthill Telephone Company fail to implement equal access in compliance with the Commission's order in Decision 01-02-018.

This order is effective today.
