IV. Conclusion

We accordingly grant the motion of the County for dismissal of the complaint without prejudice. The deposited funds in the escrow account shall be returned to the County. The return of the deposited funds in no way prejudges the merits of either party's substantive claims regarding the amount owed to AT&T for past services rendered to the County, or to any other legal or equitable claims that either party may bring in a court of separate jurisdiction. We reserve the option to separately issue an order to show cause as to whether the County should be found in violation of Rule 1 and subject to sanctions in connection with its representations to the Commission relating to this complaint.
