Comments on Proposed Decision

The proposed decision of the ALJ in this matter was mailed to the parties in accordance with Pub. Util. Code § 311(d) and Rule 77.1 of the Rules of Practice and Procedure. Comments were filed by TURN and SCE. TURN reiterated its prior position that an evidentiary hearing is needed to determine the financial impact of the change of the reimbursement effective date. SCE replied, supporting the proposed decision as written. SCE contends that TURN's comments regarding potential costs are mere hyperbole, with the object of creating a factual issue that has no basis in reality. We agree with SCE. An evidentiary hearing is not needed.
