STATE OF CALIFORNIA GRAY DAVIS, Governor

PUBLIC UTILITIES COMMISSION

505 VAN NESS AVENUE

SAN FRANCISCO, CA 94102-3298

June 28, 2001 CA-43

TO: PARTIES OF RECORD IN APPLICATION 00-03-063

This is the draft decision of Administrative Law Judge (ALJ) Bushey. It will be on the Commission's agenda at the meeting on July 12, 2001. The Commission may act then, or it may postpone action until later.

When the Commission acts on the draft decision, it may adopt all or part of it as written, amend or modify it, or set it aside and prepare its own decision. Only when the Commission acts does the decision become binding on the parties.

Although this matter is uncontested, the Commission has imposed conditions on the grant of authority. Thus, the draft decision is subject to public review and comment prior to issuance. However, applicant has agreed that this public review and comment period may be shortened.

Pursuant to Rule 77.7(f)(9), comments on the draft decision must be filed on July 5, 2001 and no reply comments will be accepted.

In addition to service by mail, parties should send comments in electronic form to those appearances and the state service list that provided an electronic mail address to the Commission, including ALJ Bushey at mab@cpuc.ca.gov. Finally, comments must be served separately on the Assigned Commissioner, and for that purpose I suggest hand delivery, overnight mail, or other expeditious methods of service.

ALJ/MAB/sid DRAFT CA-43

Decision DRAFT DECISION OF ALJ BUSHEY (Mailed 6/28/2001)

BEFORE THE PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA

Petition of Nonprofits' Insurance Alliance of California for Modification of Resolution 18351 to Adopt General Order 160-A for Approval of Liability Insurance Issued By Insurance Issued By Insurance Pooling Arrangements Authorized Under California Corporations Code, § 50051.1 as Adequate Protection Against Liability.

Application 00-03-063

(Filed March 23, 2000)

Background

On March 23, 2000, the Nonprofits' Insurance Alliance of California (NIAC) filed this application. NIAC seeks a determination that the liability coverage provided to its members is adequate evidence of liability protection required by § 40011 and General Order (GO) 160-A for "not-for-hire" private carriers. NIAC is not a California licensed insurer, per se, as is required by GO 160-A.

On June 15, 2000, the assigned Administrative Law Judge held a prehearing conference. The applicant submitted an appearance. No other party appeared. The applicant stated that the application was complete, and requested expeditious ex parte treatment of the application. There are no protests.
