Draft Resolution T-16763 will be on the March 16, 2004 agenda of the California Public Utilities Commission. This resolution proposes to 1) Shorten the time frame for carriers to file claims; 2) Revises the format of the CTF claim worksheet and CTF claim procedures to be consistent with program changes adopted by the Commission on May 8, 2003 in Res. T-16742; 3) Adopts specific requirements for E-rate customers who wish to also receive California Teleconnect Fund Discounts; 4) Eliminates the provision for amended CTF claims.

Pursuant to Public Utilities (PU) Code 311 (g), these draft resolutions are available for public comment. Comments should be focused on factual, legal, and/or technical errors in the draft resolution and/or comments of other parties. Opening comments, which are due on February 25, 2004, must be limited to five pages in length and shall include a subject index listing the recommendations to the draft resolution, a table of authorities, and an appendix setting forth the proposed revised findings and ordering paragraphs. Reply comments, which are due on March 3, 2004, shall be limited to identifying misrepresentations of law, fact, or condition of the record contained in the comments of other parties. Replies shall not exceed three pages in length and shall be submitted and served in the same manner as opening comments.
The date of submission is the date the comments are received by the Telecommunications Division. Late-filed opening comments and/or reply comments will ordinarily be rejected. However, in extraordinary circumstances, a request for leave to submit comments or replies late may be filed together with proposed comments/replies. An accompanying declaration under penalty of perjury shall be submitted setting for the all the reasons for the late submissions.

Res. T-16763 will be on the agenda of the Commission's February 26, 2004 meeting. The Commission may vote on this resolution or it may postpone a vote until later. When the Commission votes on a draft resolution, it may adopt all or part of it as written, amend or modify it, or set it aside and prepare a different resolution. Only when the Commission acts does the resolution become binding on the parties.
