SUBJECT: DRAFT RESOLUTION TO ADOPT GENERAL ORDER 75-D (REGULATIONS GOVERNING STANDARDS FOR WARNING DEVICES FOR AT-GRADE HIGHWAY-RAIL CROSSINGS IN THE STATE OF CALIFORNIA) TO SUPERSEDE AND REPLACE GENERAL ORDER 75-C

This is a draft Resolution (SX-73) of the Consumer Protection & Safety Division. It will be on the August 24, 2006 Commission meeting agenda. The Commission may vote on this resolution, or it may postpone a vote until later. When the Commission votes on the resolution, it may adopt all or part of it as written, amend or modify it, or set it aside and prepare a different resolution. Only when the Commission acts does the resolution become binding.

Interested parties may submit comments on the draft within 20 days of date of this Notice of Availability. Consistent with Rule 2.3(b) of the Commission's Rules of Practice and Procedures, service may be made by email. An Internet link to these documents was sent via email to all the parties on the service list who provided an email address to the Consumer Protection & Safety Division. An electronic copy of these documents can be viewed and downloaded at the Commission's website, www.cpuc.ca.gov (enter SX-73 in the Search This Site window). Any recipient of this Notice of Availability, who is not receiving service by electronic mail or who is unable to access the link to the Commission's website, may request a paper copy of the above documents by contacting:

Parties must serve a copy of their comment on all persons on the Service List attached to the draft resolution on the same date that the comments are submitted to the Division. Comments shall be limited to five pages in length. They shall focus on factual, legal or technical errors in the proposed resolution. Parties should send comments in electronic form to those appearances and the state service list that provided an electronic mail address to the Commission. Service by U.S. mail is optional, however, if there is no email address available, the email is returned to the sender, or the recipient informs the sender of an inability to open the document, the sender shall immediately arrange for alternate service (regular U.S. mail shall be the default, unless another means - such as overnight delivery is mutually agreed upon). The current service list for this proceeding is available on the Commission's website, www.cpuc.ca.gov (enter SX-73 in the Search This Site window).

Late-submitted comments will ordinarily be rejected. However, in extraordinary circumstances a request for leave to submit comments late may be filed. An accompanying declaration under penalty of perjury shall be submitted setting forth all the reasons for the submission.

Replies to the comments may be submitted five days after the comments are submitted and shall be limited to identifying misrepresentations of law or fact contained in the comments of other parties. Replies shall not exceed five pages in length, and shall be submitted and served in the manner as comments.
