6. Additional Requirements
Because we conclude that Intervenor did not make a substantial contribution to D.00-09-052, we do not consider whether Intervenor meets other requirements for an award of compensation. 6 Section 1803 makes it clear that a customer must make a substantial contribution to the Commission's order or decision in order to be eligible for compensation. In the absence of a substantial contribution, it is irrelevant whether Intervenor would have satisfied other requirements for an award.
6 These requirements include a showing that the customer's participation was productive. A finding must also be reached as to whether the hourly rates and hours, as well as other miscellaneous costs, are reasonable. (See D.98-04-059.)
