5. Category and Need for Hearing

In Resolution ALJ 176-3018, issued on June 24, 1999, the Commission preliminarily categorized this proceeding as ratesetting, and preliminarily determined that a hearing is necessary. However, at the PHC held September 8, 1999, the parties agreed that a hearing would probably not be necessary.⁴ This decision contains a final determination that the category for this proceeding is ratesetting, and that a hearing is not necessary.
