ADMINISTRATIVE LAW JUDGE'S RULING

SOLICITING COMMENTS ON TECMARKET WORKS FINAL REPORT

As discussed at the June 22, 2005 prehearing conference, TecMarket Works is under contract to Energy Division to assist in the review of the utilities' proposed energy efficiency portfolio plans with respect to cost-effectiveness and related issues. TecMarket Works Draft Report was previously filed in this docket as an attachment to the Peer Review Group (PRG) assessments. That report was based on information available to TecMarket Works as of approximately two weeks before the utilities filed their June 1 portfolio plans.¹ Since then, there has been an ongoing exchange of additional information between the utilities and TecMarket Works.

Accordingly, TecMarket Works has updated its report to reflect information that was not available at the time it prepared its initial evaluation. TecMarket Works Final Report is attached to this ruling. It will be filed with this ruling at the Commission's Docket Office as soon as practicable, and thereby become part of the record in this proceeding.

As described in the June 30 Assigned Commissioner's Ruling and Scoping Memo, interested parties will have an opportunity to comment on the updates reflected in TecMarket Works Final Report on July 20. This report will also be available to inform the Case Management Statement process described in the assigned Commissioner's ruling.

IT IS RULED that:

1. The attached TecMarket Works Final Report is to be filed with this ruling, and thereby become part of the record in this proceeding.

2. Comments on the updates reflected in this report are due no later than July 20, 2005, as noticed in the June 30 Assigned Commissioner's Ruling and Scoping Memo.

3. All documents in this proceeding are to be served pursuant to the Electronic Service Protocols attached to my June 8, 2005 ruling, and consistent with Rules 2.3 and 2.3.1.
