Planned Participation

Section 1804(a)(2)(A)(I) requires NOIs to include a statement of the nature and extent of the customer's planned participation in the proceeding to the extent this can be predicted. UDI's NOI states that UDI, on behalf of The 19th Street Neighbors, will focus on helping the Commission obtain information concerning the removal of barriers, adding flexibility to the process, and the costs and benefits of the program. The 19th Street Neighbors want to open the design and construction of overhead conversions to competition and revise the current funding mechanisms in order to encourage investment in the process.

The 19th Street Neighbors expect UDI to attend and provide information at the workshops, proposed discovery requests, present testimony and cross-examination of witnesses at evidentiary hearings, and prepare briefs and comments on any proposed decision in this proceeding.

The 19th Street Neighbors understand that there are numerous parties, including others seeking intervenor compensation, participating in this proceeding, and states that it is mindful of the need to avoid duplication. UDI brings the technical knowledge and experience gained in the design and coordination of Rule 20 overhead conversions for hundreds of residential, commercial, and public work projects. UDI opines that no other participant possesses this type of background, and therefore there will not be any duplication of work effort.

After consulting with Commissioner Duque, I encourage UDI to work actively with the other parties and the Commission staff to agree among themselves on issues that they will each address so as to avoid duplication of effort in addressing these issues, and to make every attempt to work towards informal resolution of issues. Merely appearing and stating positions will not assure compensation. This Rulemaking will be more effective if the parties can narrow differences and resolve issues so that the direction can be focused and effective and the Commission can complete its report to the legislature expeditiously.
