CPUC INVESTIGATIONS RESULT IN ENFORCEMENT ACTIONS AND FINES IMPOSED ON VARIOUS MOVING COMPANIES
SAN FRANCISCO, August 5, 2008 - The California Public Utilities Commission (CPUC), in its ongoing commitment to consumer protection, has taken a number of actions to protect consumers from illegally operating moving companies.
During the second quarter of 2008, the CPUC's Consumer Protection and Safety Division (CPSD), Transportation Enforcement Section, took the following enforcement actions against moving companies for violations of the Public Utilities Code and CPUC rules and regulations, including Maximum Rate Tariff 4 (MAX 4), which contains maximum rates that carriers must observe as well as rules and regulations governing intrastate moves.
Administrative Citation
Three companies were cited and fined (totaling $3,000) for violations ranging from:
1. Operating without a valid permit (unlicensed, suspension)
2. Failing to comply with consumer protection rules in MAX 4.
Companies cited were:
1. Michael Considine dba Mountain Transport, Crestline (Unlicensed)
2. Horizon Van Lines, Northridge (MTR 189812)
3. Chandler Romero dba Chandler Romero Delivery, Palm Springs (Unlicensed)
Phone Disconnect
In its ongoing efforts to clamp down on illegal moving companies, the CPUC had telephone service shut off to two moving companies operating in California without a household goods permit. These companies continue to advertise and hold themselves out to engage in the business of transporting used household goods, notwithstanding CPUC staff directives to immediately cease and desist unlawful acts and to obtain a household goods permit. According to Section 5322 of the Public Utilities Code, any consumer aggrieved by this action may file a complaint with the CPUC and request a hearing.
1. Richard D. Wilson dba Burton & Wilson The Piano Craftsmen, Scotts Valley (MTR 190,429-Denied). The defendant operates a piano restoration business and advertises his services in the Yellow Pages under "Piano Tuning and Repair". However, the defendant also advertises to offer moving services of used pianos unrelated to his restoration business under the "Piano and Organ Moving" section of two major Yellow Pages (2006-2007 issue of Valley Yellow Pages for Santa Cruz County and 2007 issue of AT&T The Real Yellow Pages for San Jose and Santa Clara), and on his website. CPSD issued a Cease and Desist letter directing the defendant to cease operation and obtain a permit. The defendant filed an application but failed to follow through with the licensing requirements. The defendant continues to advertise and provided rate quotes as evidenced by CPSD calls. CPSD obtained an order "Finding of Probable Cause" signed by Santa Cruz County Superior Court Judge Robert Atack. The order finds that telephone service at two specified numbers was being used to violate criminal laws of the State of California.
2. Baofeng Qi and Peter Wang dba Ace Movers, Oakland (Unlicensed). The defendants used a fictitious Cal-T number to advertise moving services without a household goods permit in the AT&T Yellow Pages (September 2007 issue for Oakland including Alameda, Albany, Berkeley, Emeryville, Piedmont, and San Leandro), and on the Internet at Yellow Pages.com and Craigslist. The defendants failed to comply with a cease and desist letter from the CPUC to voluntarily disconnect the phone numbers and to obtain a household goods permit. CPSD obtained an order "Finding of Probable Cause" signed by Alameda County Superior Court Judge Beverly Daniels-Greenberg. The order finds that telephone service at one specified number was being used to violate criminal laws of the State of California.
Official Notice
Nine companies were issued Official Notice for one or more of these violations:
1. Operating and advertising without a permit
2. Operating after revocation of permit
3. Time bar not properly completed; incorrect computation of time
4. Documentation violation (Combined Agreement For Moving Services and Shipping Order and Freight Bill)
5. No Important Notice About Your Move

Craigslist - CPSD was able to arrange with Craigslist, an Internet advertising medium, to install a direct link from their Labor/Moving ads page to the CPUC website. The link directs the general public to the "Moving Companies" informational page on the CPUC website. This page provide the public with a wealth of information such as consumer advisories, warnings about moving scams, license status of prospective moving companies, moving guide, how to file a complaint, and CPUC investigations of moving companies. Staff also periodically scans Craigslist want-ads for passenger services as well as moving service to determine whether they the ads are placed by licensed carriers. CPSD contacts Craigslist to "flag" or remove those carriers' ads that are advertising for services without having a valid permit. CPSD also contacts each licensed carrier, if needed, to cite them for not putting their license Cal-T or TCP license information on the Craigslist ad, which is required by CPUC statute.
