Petitions to Intervene

On April 21, 2000, the Automated Power Exchange (APX) filed a petition to intervene in this proceeding. On June 7, 2000, I contacted the attorney representing APX to clarify the extent of APX's planned participation in the proceeding. At this point, APX plans simply to monitor the proceeding. Therefore APX will receive Information Only status at this time. If APX demonstrates in the future that it will actively participate in the proceeding, I will grant it Interested Party status at that time.

On April 27, 2000, APS Energy Services, Inc. (APSES) filed a petition to intervene in this proceeding. On June 8, 2000, I contacted the attorney representing APSES to clarify the extent of APSES' planned participation in the proceeding. APSES plans to participate actively in Phase 2 through cross-examination and briefing of the issues. Therefore I will grant APSES Interested Party status.

On May 19, 2000, Duke filed a motion to intervene in response to SCE's Motion. Following the filing of its motion, Duke appeared at the hearings in Rulemaking 99-10-025 and was granted Interested Party status. Accordingly, the motion by Duke is dismissed as moot.

On June, 2000, El Paso Merchant Energy, L.P. (EPME) filed a petition to intervene in this proceeding. EPME states that it may file comments on the Proposed Decision in Phase 1 and plans to be actively involved in all aspects of Phase 2. Therefore I will grant EPME Interested Party status.

Therefore, IT IS RULED that:

1. The motion of Southern California Edison Company to modify the scope of Phase 2 is denied. The scope is clarified as set forth above.

2. The motion to intervene by Duke Energy North America is dismissed as moot.
