SETTING A PREHEARING CONFERENCE AND
REQUIRING THE FILING OF PREHEARING CONFERENCE
STATEMENTS BY ALL PARTIES

This ruling sets a prehearing conference (PHC) for March 23, 2000 from 2:00 p.m. to 4:00 p.m. in the California Public Utilities Commission (Commission) Courtroom, located at 505 Van Ness Avenue, San Francisco, California.

Parties shall file and serve PHC statements by no later than March 17, 2000.

The PHC statements shall also be transmitted to the assigned Administrative Law Judge by facsimile at (415) 703-1723 or by e-mail addressed to tom@cpuc.ca.gov by no later than March 17, 2000.

Background

On January 20, 2000, Zacky and Sons Poultry (Zacky Farms) filed a complaint against Southern California Edison Company (Defendant) in this proceeding. The complaint alleges that Defendant has violated Edison Tariff Schedule TOU-PA -5 by failing to provide electrical service to a Zacky Farms processing facility, at reduced rates applicable to agricultural uses. The complaint also alleges that Defendant has applied TOU-PA-5 in an inconsistent and discriminatory manner in violation of Section 453 of the Public Utilities Code.

On February 7, 2000, the Docket Office of the Commission served Instructions to Answer on Defendant by certified mail. Defendant must file and serve its answer by no later than March 8, 2000.
