OPINION APPROVING VOLUNTARY REVOCATION
OF OPERATING AUTHORITY
BroadBand Office Communications, Inc. (BBOC) filed this application, pursuant to Pub. Util. Code § 451 and General Order (GO) 96-A, requesting authority to withdraw its Certificate of Public Convenience and Necessity (CPCN) to provide resold and limited facilities-based competitive local exchange and long distance telecommunications services in California.
In Decision (D.) 01-10-063, the Commission granted the request of BBOC to withdraw from the local exchange and long distance service, on the condition that it send a notice to its customers advising them of BBOC's termination of service effective 10 days following the notice. The order required BBOC to send a compliance report to the assigned Administrative Law Judge (ALJ) certifying that the customer notification had been sent as directed, and that any remaining customers who had not chosen another carrier after the final notice had been transferred to the underlying incumbent local exchange carrier and not disconnected for failure to choose another provider.
On January 3, 2002, BBOC provided the required notice to the assigned ALJ confirming that all former customers had been transferred to the proper incumbent carrier, either Pacific Bell Telephone Company or Verizon California, or to the carrier of the customer's choice.
Therefore, at the request of BBOC, we will revoke its certificate of public convenience and necessity to provide resold and limited facilities-based competitive local exchange service, inter local access and transport area (LATA), and intraLATA services in California, effective with this order.
This is an uncontested matter in which the decision grants the relief requested. Accordingly, pursuant to Pub. Util. Code §311(g)(2), the otherwise applicable 30-day period for public review and comment is waived.
1. BBOC, a certificated telecommunications carrier, seeks to withdraw from the provision of local exchange and long distance service.
2. As of January 3, 2002, all of BBOC's former customers have been transferred to Pacific Bell Telephone Company, Verizon California, or to the carrier of the customer's choice.
BBOC's CPCN to provide competitive local exchange, interLATA, and intraLATA services in California should be revoked, as requested by the carrier.
IT IS ORDERED that:
1. The Certificate of Public Convenience and Necessity for operating authority held by Broadband Office Communications, Inc. (U-6326-C) is revoked.
2. This proceeding is closed.
This order is effective today.
