7. Category and Need for Hearings

In Resolution ALJ 176-3135, dated June 9, 2004, the Commission preliminarily categorized this proceeding as ratesetting and preliminarily determined that an evidentiary hearing would not be necessary. Based on the record of this proceeding, we affirm that this is a ratesetting proceeding and that a hearing is not necessary.
