IV. CONCLUSION

Because the UNE prices set for Roseville in D.00-06-080 do not comply with current law, the Commission grants rehearing and reopens the above-referenced docket. In addition, we shall order that Pacific Bell's interim, deaveraged prices for local loops, as set forth in the Pacific Bell/AT&T interconnection agreement filed August 14, 2000 with this Commission, be used as a proxy for Roseville's interim local loop prices. With respect to Roseville's other interim UNE prices, the prices approved in D.99-11-050 for Pacific Bell shall be adopted as proxies. All interim prices for Roseville shall be subject to true up, with interest, upon the determination of Roseville's final UNE prices.

THEREFORE, IT IS ORDERED that:

1. Rehearing of D.00-06-080 is granted and the UNE prices set for Roseville therein are hereby vacated.

2. The Zone 2 local loop prices set forth at Attachment 8 of the Pacific Bell's interconnection agreement with AT&T Communications of California, Inc., filed August 14, 2000, as approved in D.00-08-011, shall be, by proxy, the interim prices for local loop access in Roseville's interconnection agreement with Covad, and shall replace the local loop prices previously designated in D.00-06-080. The interim prices here approved shall be subject to true up, with interest, pending the determination of final local loop prices for Roseville.

3. The UNE prices for network elements other than the local loop that were approved in D.99-11-050 for Pacific Bell shall serve as the proxy for Roseville's interim UNE prices and shall also be subject to true-up, with interest, upon the determination of Roseville's final UNE prices.

4. Roseville shall modify the Interconnection Agreement previously filed June 26, 2000 to conform to the orders of this decision. The parties shall sign the modified Interconnection Agreement within ten days of the date of this decision, and the date of Commission approval shall be the date signed. The parties shall file and serve on parties to this proceeding the signed Interconnection Agreement within two weeks of the date of this decision.

5. The above-referenced docket is reopened and the assigned Administrative Law Judge shall notify the parties of the time and place for a prehearing conference to establish proceedings to consider Roseville's final UNE prices.

This order is effective today.
