7. Comments on Proposed Decision

The proposed decision of ALJ Michelle Cooke in this matter was mailed to the parties in accordance with Section 311(d) of the Public Utilities Code and Rule 77.1 of the Commission's Rules of Practice and Procedure. Comments were filed by SCE, PG&E, EPUC, BART, TURN, BOMA of San Francisco/BOMA of California, CLECA/CMTA, AECA, CLFP, Farm Bureau, ICP, WPTF, DACC, CRA and Los Angeles Unified School District, Kinder, Wal-Mart, and Penney jointly filed opening and reply comments.

With the exception of TURN, the comments on the proposed decision uniformly opposed the modifications to the settlement spelled out in the proposed decision. For this reason, the proposed decision has been modified to reflect their rejection of the proposed changes to the settlement and instead to direct the utilities to incorporate default critical peak pricing tariffs for large customers into their next rate design proceedings or other appropriate proceeding if directed by the Commission.
