Procedural History
Pacific filed this application on August 18, 1999. A timely protest was filed by Ground Systems, Inc. dba The Airport Bus (The Airport Bus), and on October 15, 1999, the application was reassigned from Examiner Kenneth Koss of the Rail Safety and Carriers Division to Administrative Law Judge (ALJ) Sheldon Rosenthal. On November 2, 1999, it was again reassigned from ALJ Rosenthal to ALJ Victor Ryerson.
ALJ Ryerson held a prehearing conference (PHC) in Los Angeles on March 6, 2000. At the conclusion of the PHC, the respective parties were directed to file an amendment to the application to update the applicant's financial information, and, if desired, an amended protest if the protestant wished to address any new information in the amendment to the application. Pacific filed a timely amendment, and The Airport Bus filed an "objection" thereto. Pacific filed a response to the objection.
No new information would be available to the Commission if we hold a hearing. Accordingly, Assigned Commissioner Richard A. Bilas issued a scoping memo pursuant to Rules 6 and 6.3 of the Commission's Rules of Practice and Procedure, in which he stated that a hearing is not necessary. Accordingly, the matter is being decided ex parte.
