OPINION

1. Summary

L. L. Tudor filed this complaint, signed by himself and 165 other persons, seeking to change the energy provider serving Death Valley, Shoshone, Tecopa, Sandy Valley, Hidden Hills and Stewart Valley Estates. The area now is served by Southern California Edison Company (SCE). The complaint seeks to have SCE's service replaced by Valley Electric Association of Nevada (Valley Electric), which has facilities geographically closer to the Death Valley area. SCE filed a motion to dismiss, alleging among other things that the complaint fails to state a cause of action for which relief can be granted by this Commission. After due consideration of the pleadings of the parties, the motion to dismiss is granted. This proceeding is closed.
