The California Public Utilities Commission will host its sixth annual public en banc on supplier diversity. The purpose of this en banc is to report on the diversity programs of the state's regulated utilities and to hear from diverse suppliers about program issues.
Members of the State legislature, utility executives, and other distinguished guests will attend.
Due to our full agenda and time constraints, if you would like to make a public comment at the en banc please submit your request by October 15, 2009, to Roland Esquivias at roe@cpuc.ca.gov or 415-703-2212.

Energy Division Advice Letter Disposition Change
As of June 25, 2007, the Energy Division of the CPUC will send utilities notices of the disposition of Advice Letters by electronic means rather than by hard copy in the regular mail, and will no longer be returning hard copies of approved tariff pages to the utilities. San Diego Office Closes
The Commission's San Diego Office will be closing permanently effective June 22, 2007 and will no longer be able to accept hand-delivered filings. Documents may be filed electronically on the Commission's website at http://www.cpuc.ca.gov/static/efiling.htm. In the event that you wish to file your document in hard copy, rather than electronically, documents should be taken directly to the Commission's lobby or mailed to the Commission's Docket Office in San Francisco, 505 Van Ness Avenue, San Francisco, California 94102. Only hand-delivered documents will be accepted by the Los Angeles office, 320 West 4th Street, Suite 500, Los Angeles, California.
Starting May 24, 2004, the Central Files Office will be open for business from 8 a.m. to 12 noon only.
To purchase Commission documents, there is a charge of 20 cents a printed page (postage prepaid) with a minimum purchase of $2.00.
The auditorium, hearing rooms, and training room at the headquarters of the California Public Utilities Commission, located at 505 Van Ness Avenue, San Francisco, California, are available for rent. CPUC decision D.09-08-027 directs the DRMEC to conduct an annual public workshop presenting the results of demand response evaluations conducted under the DRMEC's oversight. This is the first of two workshops and will cover demand response program process evaluations; the second workshop, during early 2010, will cover demand response program load impact evaluations.

FORUM INFORMATION:
The CSI Program Forum was established to provide an ongoing opportunity for public stakeholders to identify and discuss top priority issues related to the administration and implementation of the PUC's portion of the CSI program.
This stakeholder workshop is an opportunity to offer feedback on the progress of the Research Development and Demonstration (RD&D) Plan to-date and also to make recommendations for the future. Questions to be addressed at the workshop include:
· Have the solicitations focused appropriately on the goals of the program and in the needed timeframes?
· Are the solicitations responsive to marketplace needs and processes?
· Is there appropriate leveraging of CSI Solar RD&D Program funding?

WORKSHOP INFORMATION:
The CPUC is required to submit a cost-benefit evaluation of the NEM program to the Legislature by January 1, 2010. In addition, the CPUC has established a methodology for assessing the costs and benefits of distributed generation programs like the CSI. Since the two evaluations are closely related, the CPUC has selected a single contractor, E3 Inc., to carry out both studies and they will be describing their approach and analysis. The main focus will be on the NEM analysis, as that is due to be complete first, but will also provide stakeholders a preview of the analysis planned for CSI cost-effectiveness. This workshop will give stakeholders the opportunity to examine the details of our evaluation approach before the reports are finalized.

The Executive Division has prepared Alternate Resolution ALJ-238 for the next Commission Agenda. Resolution ALJ-238 in the matter of the Appeal of Air Ride Moving & Storage of Citation FC-252, affirms, in part, and amends, in part, pursuant to Resolution ALJ-187. Unlike the proposed resolution, the Alternate orders Air Ride to refund the full amount due to the customer under the Commission's regulations, $2,641, and fines Air Ride $500. This closes the proceeding.

NOTICE OF RESOLUTION AUTHORIZING PUBLIC DISCLOSURE OF INVESTIGATION RECORDS
Resolution L-386 authorizes disclosure of records concerning the California Public Utilities Commission Consumer Protection and Safety Division's investigation of the derailment of San Francisco Municipal Transit Agency Cable Car # 12 that occurred on July 13, 2008. Draft Resolution L-386 will be on the agenda at the Commission's October 29, 2009 meeting. The Commission may then vote on the resolution or it may postpone a vote until later. The Commission may adopt all or part of L-386, amend or modify it, or set it aside and prepare a different resolution.
On October 19, 2009, the draft resolution was circulated to the Resolution L-386 service list, pursuant to California Public Utilities Code § 311(g) and Rule 14.2(c)(2) of the Commission's Rules of Practice and Procedure. Interested parties may review the draft resolution and service list at the "Currently Open for Comment" section of the Commission's Internet site at www.cpuc.ca.gov.
Interested parties may file comments on the draft resolution. (Rule 14.6 (c)(7).) The Communications Division has prepared Resolution T-17231 for the October 29, 2009 Commission meeting, regarding the application of TC Telephone LLC for eligible telecommunications carrier (ETC) status. The resolution approves limited ETC status for TC Telephone LLC. The comment period for this resolution has been waived pursuant to PU Code § 311(g)(2).

The Communications Division has prepared Resolution T-17235 for the October 29, 2009, Commission Agenda. This Resolution denies the request of TracFone Wireless, Inc. (U-4231-C) (TracFone) to be designated as an Eligible Telecommunication Carrier (ETC) for the purpose of receiving federal Lifeline support. The Commission finds that it is not in the public interest to designate as an ETC a telephone carrier that: (a) has failed to pay - and refuses to pay - public purpose program surcharges and user fees on its non-subsidized California intrastate revenue; and (b) argues that it does not have to pay such fees because it is not a public utility. The Commission also directs Communications Division (CD) to prepare an Order Instituting Investigation and Order to Show Cause why TracFone should not be ordered to pay all outstanding user fees and surcharges, and penalized for its violation of the statutes, rules, and orders requiring such payment. The Communications Division e-mailed the Notice of Availability letter for this resolution to parties in accordance with PU Code Section 311(g)(1).

This Resolution approves cost recovery for a power purchase agreement resulting from bilateral negotiations between PG&E and Solaren Corporation, pursuant to California's renewables portfolio standard (RPS) program. The Consumer Protection and Safety Division has prepared Draft Resolution SX-94 for the November 20, 2009
Commission Meeting. This resolution grants the City of Sacramento's request for continuing an existing impaired overhead railroad clearance pursuant to General Order 26-D, Section 15 -Lesser Clearances Lawfully Created Prior to the Effective Date of This Order. The continuation of the impaired clearance is necessary due to a need to shift tracks slightly at the identified location and an inability to bring the location to current standards without replacement of the entire railroad bridge structure. The owning railroad, Union Pacific Railroad, has indicated it has no objections to continuance of the existing condition.
